Welcome to Yellow Grove.

I’m Dave Towers and I offer email marketing strategy, email copywriting and clarity consulting to help business owners cut through the noise and make their email actually work.

This document lays out how I work, what you can expect and what we both agree to when you hire me.

It’s written in plain English because legalese sucks.

1. Definitions (Quick and Painless)

  • You / Client – That’s you, the person or business hiring me to help get your emails firing.
  • Me / I / YellowGrove – That’s me, Dave Towers, operating as YellowGrove from Victoria, Australia.
  • Quote – A written price estimate, valid for 30 days.
  • Copy Brief – The agreed-upon summary of the work, scope, goals and tone.

2. Scope, Quotes & Revisions

  • All quotes are valid for 30 days from the day I send them.
  • Quotes are based on the info you give me at the time. If the scope changes, I may re-quote.
  • Your project includes 2 rounds of revisions per deliverable. Extra revisions are charged hourly.
  • New deliverables or big rewrites = new quote.

3. Payments

  • A 50% deposit secures your spot and kicks off the project.
  • The remaining 50% is due on delivery of final assets.
  • For longer projects, retainers or phased work, we’ll agree on a schedule.
  • Two ways to pay me: bank transfer (preferred) and Stripe to keep things simple.

4. Communication, Meetings & Delivery

  • I handle all communication by email unless we agree otherwise.
  • My typical reply time is within 1–2 business days (Mon–Fri).
  • We’ll schedule a deep-dive meeting early in the project to unpack your business, clarify goals and uncover the golden nuggets that will shape your strategy.
  • Your participation is required. These meetings are collaborative, not passive. The more you contribute, the more targeted and effective the strategy.
  • If I need to bring in a trusted contractor (designer, developer), I’ll let you know. You’ll still deal with me directly and just to be clear, you won’t get direct access to my contractors.
  • Disappear for 30+ days? Project goes dormant. A $250 restart fee applies to resume.

5. Confidentiality

  • I treat your business info, strategy and content as confidential.
  • I don’t share or reuse your stuff unless you say it’s okay.
  • Sensitive info like logins or customer lists is stored securely and only used for your project.

6. AI Disclosure

  • I use AI tools to help research, brainstorm, crunch data and speed up delivery.
  • All outputs are reviewed, rewritten and approved by me… no robo-dribble here.

7. Ownership & Portfolio Use

  • Once full payment is received, you own the final copy.
  • Once full payment is received, copyright ownership transfers to ‘the Client’ unless otherwise agreed in writing.
  • I may showcase your project (screenshots, excerpts, case studies) in my portfolio or marketing. If you want to opt out, just say so in writing.

8. Results & Responsibility

  • I promise strategic, well-crafted work tailored to your business. I don’t promise specific sales or open rates… those depend on factors beyond my control.
  • You’re responsible for how the final copy is used once approved.

9. Cancellations & Terminations

  • You can cancel anytime. Once the 50% deposit has been received and I’ve started work, that deposit is non-refundable. If you decide to cancel after work has begun, you won’t get the deposit back, but I won’t invoice you beyond that unless additional work has already been completed.
  • I can also step away if scope shifts dramatically or communication breaks down.

10. Legal Bits

  • This agreement is governed by the laws of Victoria, Australia.
  • Disputes? Let’s try to talk it out first. If needed, we’ll go through the appropriate Victorian legal channels.

11. Fair Use of Content (Don’t Rip Me Off)

Any content, guides, or downloads I share with you on the website, in emails, or via paid services is for your own personal or business use only. You can’t resell, republish, or pretend it’s yours. Don’t copy/paste my stuff into your own materials unless we’ve agreed to that in writing.

12. Disclaimer (Because Internet Advice Has Limits)

Everything I share on my site, in emails, or in downloads is for general informational purposes only. I do my best to provide smart, helpful insights, but nothing is guaranteed. You’re responsible for how you use it. No silver bullets, no magic wands just strategy and clarity.

13. Limitation of Liability

To the extent permitted by law, I’m not liable for any loss, damage, or weird side effect that happens from using my services, strategies or advice. That includes (but isn’t limited to) lost profits, missed sales or minor existential crises.

14. Timelines & Delivery Expectations

  • I’ll always aim to deliver on time and I’ll communicate early if anything changes. If your response time delays delivery, I may need to adjust timelines or reschedule your spot in my calendar.

15. Client Delays & Bottlenecks

  • If delays on your end (like missing info, content, or approvals) slow the project by more than 14 days, I may reschedule or pause work. A restart fee or revised quote may apply.

16. Third-Party Platforms & Tech Disclaimer

  • I can’t be held responsible for bugs or breakdowns on third-party platforms like email service providers, domain hosts or CRM tools. I’ll help you troubleshoot what I can, but some things are out of our hands.

17. Final Deliverables & File Handling

  • Final deliverables are provided in Google Docs format unless otherwise agreed. I’ll keep a copy for 60 days. After that, it’s your responsibility to back up and store them.

18. Force Majeure (a.k.a. “Stuff Happens” Clause)

  • If something beyond my control like illness, natural disasters, power outages, or rogue internet goblins delays delivery, I’ll let you know and reschedule as needed without penalty.
